Our Trading Terms and Policies

 

The Company refers to: iDomain Pty Ltd and all associated entities and trading names.
The Customer refers to: any entity that The Company is performing work for.

 

1. Work Type
All work is determined as Time and Materials unless agreed to in writing prior to the commencement of the work.

 

2. Expenses
Unless explicitly included as a component of a Fixed Price quotation, all travel, accommodation and other
out -of-pocket expenses incurred by The Company in performing the work will be charged directly to The Customer with a handling fee of 5% added.

 

3. Confidential Information
All information is treated as “Commercial-in-Confidence”.

 

4.  Acceptance
It is The Customers responsibility to perform sufficient testing of the application system prior to implementing any or all of the work in a live environment.

Any work, service or product used in a live environment prior to any formal Customer acceptance testing is deemed to have been accepted by The Customer

 

5.  Warranty
Warranties are only supplied with Fixed price work for no more than thirty (30) days unless agreed in writing.  This warranty period commences upon acceptance, or when the application system is used in a live environment, whichever is the earlier.
No warranty applies to work performed on a Time and Materials basis. 

 

6. General Liability
Neither party shall be liable to the other for loss of profit, income or saving or for any indirect, consequential or special damages regardless of whether the liability is based on a claim for negligence, indemnity, breach of contract, misrepresentation or any other basis.

 

In no event shall The Companies liability under these terms and conditions or any transaction contemplated by these terms and conditions exceed the replacement of the products or supply of equivalent products or the payment of the purchase price for the products in question.

 

Neither party shall be in default hereunder by reason of any failure or delay in the performance of any obligation under these terms and conditions by reason of force majeure
